Angered by a controversial Allergan (AGN1 ) patent maneuver, a handful of lawmakers introduced a bill that would prohibit tribal sovereign immunity from being used to block certain types of patent challenges.

“The timing of this bill is interesting. The PTAB only recently decided that it has the legal authority to review patents owned by Native American tribes, and rather than let the legal process around that decision play out, the sponsors of this bill are proposing essentially to codify that ruling,” said Rachel Sachs, an associate professor at the Washington University School of Law, who studies the intersection of patent and health law.
